By accessing this website, requesting a quote, placing an order, submitting a purchase order, or purchasing any product from Ampstate, you agree to the following Terms & Conditions.

1. Industrial Equipment Disclaimer

Ampstate supplies industrial electrical equipment, components, replacement parts, MCC buckets, breakers, bus plugs, switchgear, transformers, disconnects, contactors, relays, and related products.

Products sold by Ampstate may include new, surplus, refurbished, reconditioned, aftermarket, replacement, obsolete, legacy, or previously installed equipment, depending on the item description or quotation.

Unless expressly stated in writing, Ampstate does not represent that it is an authorized distributor, agent, reseller, or representative of any original equipment manufacturer. Manufacturer names, trademarks, brands, and part numbers are used only for identification, compatibility, reference, or replacement purposes.

2. Customer Responsibility for Fit, Function, and Application

The customer is responsible for confirming that any product purchased from Ampstate is suitable for the intended application, installation, enclosure, voltage, amperage, interrupting rating, short-circuit rating, mounting style, dimensions, trip unit, accessories, code requirements, certification requirements, and site conditions.

Ampstate may provide technical information, cross-reference suggestions, equivalent part suggestions, or compatibility guidance; however, such information is provided for convenience only and must be verified by the customer, their licensed electrician, engineer, authority having jurisdiction, inspector, or qualified professional before purchase, installation, or use.

The customer is fully responsible for ensuring compliance with all applicable electrical codes, safety standards, project specifications, engineering requirements, and local regulations.

3. Quotations and Pricing

All quotes are subject to prior sale, availability, and final confirmation. Pricing may change without notice until the order is accepted by Ampstate in writing.

A quote does not reserve inventory unless Ampstate confirms reservation in writing. Ampstate may correct typographical errors, pricing errors, product description errors, or availability errors at any time before shipment.

Taxes, duties, customs fees, brokerage charges, freight, insurance, and import/export costs are not included unless expressly stated in writing.

4. Orders and Acceptance

An order is not accepted until Ampstate confirms acceptance in writing, receives required payment or deposit, and confirms availability.

Ampstate may refuse, cancel, or revise any order if:

  • the product is unavailable;

  • payment is not received;

  • there is a pricing, description, or inventory error;

  • the order appears fraudulent or unauthorized;

  • export, compliance, or safety concerns apply;

  • the product is not suitable for the stated use; or

  • Ampstate is unable to fulfill the order on reasonable commercial terms.

5. Payment Terms

Payment terms are as stated on the invoice, quotation, or order confirmation. Unless written credit terms are approved by Ampstate, payment is due before shipment.

Deposits, special-order payments, rush-order payments, sourcing fees, engineering review fees, and custom work charges may be non-refundable once work has started or the item has been reserved, procured, tested, modified, packaged, or shipped.

Late payments may result in order delay, cancellation, collection action, or withholding of future shipments.

6. Shipping, Delivery, and Risk of Loss

Shipping dates and delivery dates are estimates only. Ampstate is not responsible for carrier delays, customs delays, weather delays, border delays, missed shutdowns, project delays, or consequential losses caused by delayed delivery.

Risk of loss transfers to the customer once the product is delivered to the carrier, unless otherwise stated in writing.

The customer must inspect shipments immediately upon receipt. Any visible shipping damage, shortage, or missing item must be reported to Ampstate in writing within 48 hours of delivery, with photos of packaging, labels, and the product.

7. Returns and Cancellations

Returns require prior written authorization from Ampstate. Products returned without written authorization may be refused.

Unless otherwise stated in writing, all approved returns may be subject to inspection, testing, restocking fees, shipping costs, and deduction for damage, use, missing parts, missing packaging, or reduced resale value.

The following items are final sale and non-returnable unless Ampstate agrees otherwise in writing:

  • special-order items;

  • custom-built MCC buckets or assemblies;

  • modified, tested, altered, configured, or wired equipment;

  • obsolete, rare, or sourced-to-order parts;

  • opened, installed, used, damaged, or field-modified products;

  • products returned without original packaging or accessories;

  • electrical components where safe resale cannot be verified;

  • clearance, liquidation, or “as-is” items.

Nothing in this policy limits any mandatory rights that may apply under applicable consumer protection laws.

8. Warranty

Unless otherwise stated in writing, Ampstate provides a limited warranty against defects in workmanship or product failure under normal use for the period stated on the invoice, quotation, or product page.

If no warranty period is stated, the default Ampstate warranty is 1 year from the invoice date for products sold as tested/refurbished/reconditioned, unless sold as-is or final sale.

Warranty coverage is limited to repair, replacement, store credit, or refund at Ampstate’s sole discretion. Ampstate is not responsible for labour, downtime, removal, reinstallation, engineering costs, testing costs, inspection costs, lost production, lost revenue, penalties, shutdown costs, or consequential damages.

Warranty does not cover:

  • incorrect installation;

  • misuse, abuse, overheating, overload, short circuit, arc flash, water damage, contamination, corrosion, improper storage, improper handling, or field modification;

  • incorrect voltage, current, interrupting rating, trip setting, application, enclosure, or environmental condition;

  • customer-selected equivalent or replacement products later found unsuitable;

  • cosmetic wear on surplus, used, or refurbished equipment;

  • failure caused by other equipment or site conditions;

  • products repaired, opened, modified, or altered by others without Ampstate’s written approval.

9. Limitation of Liability

To the maximum extent permitted by law, Ampstate’s total liability for any claim related to a product, quote, order, shipment, delay, defect, or website use is limited to the amount paid by the customer for the specific product giving rise to the claim.

Ampstate is not liable for indirect, incidental, special, punitive, or consequential damages, including loss of profit, loss of production, project delay, electrical shutdown, business interruption, labour charges, inspection costs, engineering costs, or replacement power costs.

10. Product Information and Website Accuracy

Ampstate makes reasonable efforts to provide accurate product descriptions, images, specifications, and availability information. However, website content may contain errors or omissions.

Product images may be representative only. The customer must verify all nameplate data, ratings, dimensions, accessories, and configuration before purchase.

11. Installation and Safety

Products sold by Ampstate must be installed, tested, inspected, and energized only by qualified personnel in accordance with applicable codes, standards, manufacturer instructions where available, and site-specific safety procedures.

Ampstate is not responsible for injuries, equipment damage, fire, electrical faults, code violations, inspection failures, or unsafe installations caused by improper selection, installation, testing, modification, or use.

12. Intellectual Property

All website content, product descriptions, photos, graphics, logos, layout, and text are owned by or licensed to Ampstate unless otherwise stated. No content may be copied, reproduced, scraped, republished, or used commercially without written permission.

13. Governing Law

These Terms & Conditions are governed by the laws of the Province of Ontario and the applicable laws of Canada. Any dispute shall be handled in the courts of Ontario, unless applicable law requires otherwise.
